Upcycle is a platform that offers intermediation and promotion services for the purchase and sale of furniture, appliances, electronics and pre-owned items (the “Services” and the “Products” respectively) either on its website www.upcyclemex.com or in any extension thereof, such as mobile applications or social networks (collectively, the “Website”) and is Responsible for the processing of personal data (the “Personal Data”) of its users who act as sellers or buyers in the Website (the “Users”) in accordance with the provisions of this privacy notice (the “Privacy Notice”).

Upcycle will protect, collect, use, monitor, share, store, transfer and destroy Personal Data in accordance with this and the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de Particulares (the “Law”) and other applicable legislation.

It is understood that before using the Services, any User has read, fully accepted and, therefore, accepts all the terms provided in this Privacy Notice. If for any reason you do not wish to give your Personal Data the treatment provided for in this Privacy Notice, the User must leave the Website immediately and refrain from using the Services offered therein or submit a request for exercise your ARCO Rights (as such term is defined below) in accordance with this Privacy Notice.

 

For what purposes will we use the personal data of our Users?

The Personal Data that we collect from our Users through any electronic means, including, without limitation, instant messaging applications, social networks, telephone, the Website and email, will be used for the following purposes:

1. Comply with obligations derived from a legal relationship between the owner of the Personal Data and Upcycle.
2. Identify Users and register them as such.
3. Create user accounts for each User and files for their Products.
4. Process and complete the publication of your Products.
5. Carry out their sale, collection and delivery.
6. Contact them to confirm information about their Products, make pickups and deliveries and resolve any queries, problems, complaints or suggestions related to the sales of the Products.
7. Make the corresponding payments to Users and third parties.
8. Receive the corresponding payments from Users and third parties.
9. Issue tax receipts.
10. Send them information about promotions, discounts and news from our store.
11. Carry out evaluations of the Products and Services.
12. Marketing, statistical purposes, advertising, promotion and prospecting.
13. Improve our Services and the online shopping experience.
14. Comply with the legal obligations that may arise.

If the User does not want their data to be used for the purposes of non-essential uses such as promotion, marketing, advertising, promotions, discounts and news in the store, they can notify the email hola@upcyclemex.com .

What personal data will we use for these purposes?

To carry out the purposes described in this Privacy Notice, we will use the following Personal Data:

1. Full name
2. Email address
3. Address for collections and deliveries and characteristics of the property
4. Cellphone number
5. Nationality
6. Reason for sale
7. Gender
8. Birthdate
9. Identification data on social networks
10. Banking information for payments (CLABE account number, credit card number, name of the holder, expiration date, etc.)
11. Information, photographs and videos of your Products or pickup and delivery addresses

How can they access, rectify or cancel their personal data, or oppose its use?

Users or their legal representatives may request Upcycle at any time (i) for access; (ii) rectification or correction of your personal information if it is out of date, inaccurate or incomplete; (iii) we delete your Personal Data from Upcycle's records when we consider that they are not being used in accordance with the principles, duties and obligations provided for in the Law; as well as (iv) oppose the use of your Personal Data for specific purposes (“ ARCO Rights ”).

Said request must be sent in writing to hola@upcyclemex.com and contain and be accompanied by the following:

1. The name of the titular User and address or other means to communicate the response to their request;
2. The documents that prove your identity or, where applicable, the legal representation of the owner of the Personal Data;
3. The clear and precise description of the Personal Data with respect to which one seeks to exercise any of the ARCO rights, and
4. Any other element or document that facilitates the location of Personal Data.

How long will Personal Data be kept?

Personal Data will be safeguarded by Upcycle and authorized third parties during the provision of the Service and subsequently only anonymous data will be retained for statistical and prospecting purposes.

Who can we share Personal Data with?

In addition to the cases provided for in the Law, Users accept that their Personal Data may be transmitted to all third parties that provide services related to the Upcycle Services (including recommended recipients) only for the purposes provided for in this Privacy Notice.

How can you revoke your consent to the use of your personal data?

The User may revoke the consent they have given to Upcycle for the processing of their Personal Data. However, it is important to keep in mind that not in all cases Upcycle will be able to respond to said request or terminate the use immediately, since it is possible that due to some legal obligation it is required to continue processing the Personal Data. Likewise, the User will take into account that for certain purposes, the revocation of their consent will imply that the Service cannot continue to be provided, or the conclusion of their relationship with Upcycle.

Use of cookies

Upcycle uses functional, analytical and marketing cookies and additional tracking and statistical technologies on its Website in order to provide a better Service to Users. These can be rejected or adjusted directly in the browser settings. However, by rejecting or eliminating these mechanisms, navigation on the Website could be affected.

Modifications to the privacy notice

Upcycle may make modifications or updates to this Privacy Notice at any time, to address new legislation, internal policies or new requirements for the provision or offering of the Services. These modifications will be available to the public through www.upcyclemex.com.
